山东大学法律系始建于1983年,后改系为院。法学院现有65名全职教师和教学辅助人员。其中教授10人,副教授27人,具有博士学位的 19人,具有硕士学位的 31人,有海外访问、进修经历的18人。另有国内知名学者、司法界人士30人为学院兼职教授。有多名教授在国家级和省级学会中担任会长、副会长等职务。法学院在校生规模近1500人,其中博士生、法学和法律硕士生800余人,本科生650余人,并有来自韩国、日本、蒙古、哈萨克斯坦、尼日利亚等十几个国家的留学生50余人,另外,还招有网络、函授、自学考试在校生2000余人。
法学院凭借山东大学浓郁的文史底蕴营造人文育人环境,并实践教学改革和教育创新,努力发展法律专门人才培养质量。1995年,根据国家教委专业调整的要求,法学院原法学、经济法、国际经济法三个本科专业合并调整为法学一个专业,并试行学分制。2000年,法学专业本科教育试行改革,实行文理兼招,并根据教育规律和社会需要开展法学专业平台上的特色教育,与英语专业合作试办双学位教育,2002年本科教育试办以日语为第一外语的日语背景法学教育,有近1/5的本科课程试行双语式教学或外教执教,知识产权法学教育、"公共卫生管理+法学"教育也将成为本科教育的试点项目。实践教学是本科教学的一大特色,法学院在10个中级法院、22个基层法院及部分检察院设立实践教学基地,有力地推动了应用型法律人才的培养。自2002年起,学院每年选派优秀学生到中国人民大学、武汉大学、厦门大学、中山大学、兰州大学等大学法学院和国外学习,增加"第二校园"经历、"海外学习"经历。
1995年始,宪法与行政法、民商法、法理学、刑法学、国际法专业、法律史学、经济法学、诉讼法学等学科相继获得硕士学位授予权,1999年,开始试行法律硕士专业学位教育。2000年,理论法学专业获得博士学位授予权。研究生教育注重创新能力的培养,"学习+研究"培养模式、"双导师制"等,有效地促进了创新型人才的培养。15名国内知名学者、15名司法界专家型法律人士作为法学院兼职教授,在双导师制下参与指导法学和法硕研究生的学位论文和成才计划。
法学院设有理论法学研究所、宪法与行政法学研究所、刑法学研究所、民商法学研究所、国际法研究所、法史学研究所、经济法学研究所、诉讼法学研究所以及法学研究所、知识产权与科技法研究中心、人权研究中心、欧盟法研究中心、美国法研究中心、刑事法律研究中心等多个研究机构,先后承担中国法制史研究、人权研究、政府执法研究、司法改革研究、物权法研究、侵权法研究、担保法研究、权力制约研究、中国立法问题研究、有组织犯罪研究、金融犯罪研究等50多项国家和省部级研究课题。其中,中国法制史研究、人权与法治研究、司法改革研究、侵权法研究、比较法研究、民间法研究、法律解释学等学术领域的研究成果在国内外有较大影响。
近几年来,法学院教师在国家核心期刊上发表学术论文500余篇,在海外发表学术文章20余篇,出版学术专著和高水平教材65部,获得国家及省部级奖励达60余项。由法学院组织、山东人民出版社出版的"法理学文库"获得法学界的高度评价。法学院知名教授主持的《人权研究》、《民间法》、《法律方法》等学术刊物在学界有着重要影响。2000年,山东省启动社会科学研究基地建设,法学研究基地设在山东大学法学院。
自建院以来,法学院曾成功地举办了十余次国际及全国性学术会议。法学院创办的全国知名专家、学者法学学术讲坛在法学界享有很高声誉,有近百名国内外知名学者曾在学术讲坛上发表讲演。由法学院承办的1994年全国法理学年会、1998年中国法律史学年会、2000年全国行政法学年会、2001年全国刑法学年会以及法律解释学、法经济学等全国性专题学术会议得到了学界的一致好评。
法学院非常重视对外交流与合作,实现对外交流与合作的三个面向:面向海外、面向国内同行、面向国家机关。与北京大学法学院、中国人民大学法学院、吉林大学法学院、浙江大学法学院等保持着密切的学术交流与合作,与司法部、山东省人民政府法制机构、山东省高级法院、山东省检察院、海南省检察院等司法部门保持着人才培养和科研合作关系,与美国、日本、法国、德国、俄罗斯、香港、台湾等十几个国家和地区的大学和研究机构保持经常性的人员和学术交流关系,与美国巴尔的摩大学、欧盟有关学术管理机构有着稳定的项目合作。学院对外交流与合作已经突破传统的人员交流和学术合作的形式,开始进入教学合作层面,在人才培养方面加强合作。与美国华盛顿大学的法律硕士教育项目已进入实质性商谈阶段,日语背景法学教育的毕业生可望在日本早稻田大学接受大学后教育。
学院十分重视院风和学风建设,强调学生的素质教育和人格教育。"以人为本,与法同行"已经成为学院格言,与未来职业道德规范紧密结合的思想教育促使法学院学生不断修养自己的品行和完善自己的人格。受到良好专业教育和人格教化的法学院毕业生大多数已成为律师、法官、检察官、企业法律顾问而服务于社会,也有相当数量的毕业生从事其他领域的工作,例如商业银行、立法机关、政府机构、教学和科研等与法律相关的多种类型的职业可供毕业生选择,还有越来越多的毕业生获得在海外大学和国内著名大学及研究机构继续深造的机会。
法学院图书资料中心现有藏书近5万余册,其中日、英等外文图书1万余册,有国内一流的日文专门书库(五十岚清图书馆),中外学术期刊达220余种。图书资料中心因其专业性、开放性和优良服务成为教学和科研辅助中心,与实验中心、法律网站、微机中心、诊所式教育专区、法律援助基地以及文瀚律师所等共同为教学和科研提供优质辅助。
1983年11月18日山东大学成立法律系,至今已近20年。20年院庆是回顾以往和展望未来的最好时机。20年来特别是由法律系转制为法学院以来,山东大学法学教育获得快速发展 。在过去20年的基础上,法学院将全面推行未来十年发展规划,在山东大学创建国内外知名高水平大学的背景中创建国内外知名高水平法学院。
An Introduction To Law school Of Shandong University
Law school of Shandong University was founded in 1983, named as Law Department at that time. The full-time academic and other staff of the Faculty numbers 65. 10 of them are professors and 27 are associate professors. Among them, 19 are doctors, 31 are masters and 18 have studied abroad as visiting fellows or professional associates. Besides, 30 famous scholars and legal experts are invited to be part-time professors here. Several professors of Law school act as presidents or vice presidents of some national or provincial academic associations. There are nearly 1,500 on-campus students, including 800 PhD and Master of Law candidates and about 650 undergraduates. Over 50 overseas students coming from more than ten countries and regions, such as South Korea, Japan, Mongolia, Kazakhstan and Nigeria, are also studying in the Faculty of Law. About other 2,000 students have enrolled in Law school through long-stance education, correspondence or self-study.
The Faculty of Law strives to build a humane educational environment based on the abundant accumulation of Shandong University in fields of history and literature, and practice teaching reforms and innovations to highlight students' comprehensive abilities. In 1995, to correspond with the Ministry of Education's requirement to adjust department settings, Law school united the original three disciplines-legal theory, economic law and international economic law, that is, legal theory and endeavored to carry out credits system. In 2000, the undergraduate education was reformed in the following two aspects. One was to enroll both students of literature background and science background. The other was to set up a distinct law course cooperating with Department of English in the light of educational rules and social requirements and students attending which might get two bachelor's degrees. In 2002, there came an undergraduate programme for students taking Japanese as their first foreign language. According to it, nearly one fifth of the courses are taught in Japanese-Chinese or by foreign teachers. Moreover, the programme of intellectual property law and public sanitation administration and law are also to be performed. Since combining teaching with practice is one of the characteristics of undergraduate education, Law school has founded teaching bases at 10 Intermediate Courts, 22 Primary Courts and some procuratorates, which prompted the students' practicing ability. Moreover, excellent students are sent to study in Law Faculties of Renmin University, Wuhan University, Xiamen University, Zhongshan University and several foreign universities every year that enrich students' experiences of "studying in a second campus" or "studying abroad".
Since 1995, the Faculty of Law had gradually obtained the authority to confer master's degree in the following disciplines, constitutional and administrative law, civil-commercial law, jurisprudence, international law, legal history, economical law and procedural law. And the LLM programme was started in 1999. In 2000, Law school gained the authority to confer doctorate's degree of jurisprudence. Law school prides itself in training graduates' ability of innovation by encouraging them not to learn but to study and supervising each student by two supervisors. 15 famous national scholars and 15 legal experts have participated in the system as part-time supervisors.
Many institutes and centers have been founded in Law school, such as Institute of Jurisprudence, Institute of Constitutional and Administrative law, Institute of Criminal Law, Institute of Civil-Commercial Law, Institute of International Law, Institute of Legal History, Institute of Economic Law, Institute of Procedural Law, Center of Intellectual Property & Science and Technology law, Center of Human Rights, Center of European Union Law, Center of American Law and Center of Criminal Law. The academic staff have undertaken over 50 national or provincial projects, including the Project of Chinese Legal Institutions History, the Project of Human Rights, the Project of Administration, the Project of Judicial Reform, the Project of Real Rights Law, the Project of Torts Law, the Project of Security law, the Project of Powers Restriction, the Project of Legislation in China, the Project of Organized Crime, the Project of Crime concerning Finance, etc. And the Faculty of Law has a national or international reputation in its study of Chinese Legal History, Human Rights and the Rule of Law, Judicial Reform, Torts Law, Comparative Law, Customary Law and Legal Hermeneutics.
In recent years, the academic staff has published more than 500 articles in national cored periodicals, 20 in foreign journals and over 65 monographs or textbooks. More than 60 of them won national or ministerial-level prizes. "The Series of Works on Jurisprudence ", hosted by Law school and published by the Shandong People's Press have a very good reputation in Chinese research area. Besides, several publications, such as "Study on Human Rights", "Customary Law" and "Legal Method" also have a big influence. In 2000, the plan of establishing social science bases was initiated in Shandong Province, among which the law research base was exactly founded in Law school of Shandong University.
Since it's foundation, Law school has successfully hosted more than ten international or national symposiums, among which Annual Symposium on Jurisprudence 1994, Annual Symposium on Chinese Legal History 1998, Annual Symposium on Administrative Law 2000, Annual Symposium on Criminal Law 2001, Symposium on Legal Hermeneutics and Symposium on Law and Economics were especially highly praised. The Faculty of Law also holds a well-known law forum and nearly one hundred famous scholars have lectured at it.
Law school pays much attention to the exchange and cooperation with the following agencies, overseas agencies, domestic law faculties and national departments. There is a very close academic relationship between Law school of Shandong University and other domestic law faculties, such as Law school of Peking University, Law school of Renmin University, Law school of Jilin University, Law school of Zhejiang University, etc. Law school of Shandong University keeps contact with the Ministry of Justice, the Bureau of Legal Institution, Shandong Province, Shandong Provincial High Court, Shandong Provincial Procuratorate and Hainan Provincial Procuratorate on educational and research affairs. Apart from those, there are constant exchange of staffs and research with universities of over ten countries or regions, such as USA, Japan, France, Germany, Russia, Hongkong and Taiwan, and steady projects cooperating with the University of Baltimore and relevant agencies of European Union. Now the traditional forms of exchange have been broken through and there comes the exchange in respect of education. For example, the project on LLM education is being negotiated with the University of Washington and material progress has been gained. And students mastering Japanese might have opportunities to further their studies in Waseda University.
Law school attaches importance to ethos and stresses on training of students' abilities and personalities. The adage of "taking human as the principle and behaving according to law " has been widely adopted by students. The ideological education, which has much to do with their future professional ethics, spurs the students to perfect their behaviors and personalities continuously. Most of the well-trained graduates are serving the society as lawyers, judges, procurators and legal counsels of enterprises; some are working for commercial banks, legislatures, government agencies, universities and other research institutions; still more and more graduates have got chances to further their studies in well-known universities and research institutions both at home and abroad.
The library of Law school has a collection of nearly 50,000 volumes of law books, including more than 10,000 English and Japanese law books, a first-class Japanese stack, also named as Wushilanqing Library. Moreover, the kinds of Chinese and foreign academic journals here amount to 220. Because of its professional and opening features and good service, the library, together with the experiment center, the law internet web, the computer center, the clinic education, the base for legal aid and Wenhan Law Firm, has become an important supporter for teaching and research.
It has been two decades since the Law Department of Shandong University was founded on Novenmber18, 1983. It is most appropriate to review the past and look forward to the future of Law school at present. The legal education of Shandong University has got rapid progress in the past twenty years, especially since the year Law department was changed into Law school. Based on that and on the orientation of Shandong University to be a national and international well-known university, Law school is to carry out the 10-year Development Programme to pursue to be a famous academic-orientated Law School
